Ariel Attack arraignment update

Today at 9am on 9/9/09, Ariel had arraignment in court. The official charge by the state is one count felony 4 criminal mischief, as expected. Ariel’s appearance was waived and motions were approved for permission to leave the state and for a later court date of November 5. That will be a disposition hearing.

Kevin Olliff Update

Activist Kevin Olliff, arrested April 16th in Los Angeles has a court date on September 18th (8:30 am) at Los Angeles Superior Court Dept 102 (210 W Temple Street, Los Angeles CA), where his lawyers will be challenging the constitutionality of his current stacked charges regarding three year old protest activity, to lower his bail amount. Both Kevin and Lindy Greene were charged with several counts of conspiracy, criminal threats, and stalking, with an added gang enhancement that will also be challenged on Kevin’s defense. Lindy posted bail and was released on house arrest with direct orders not to communicate with other activists.

Remembering the Attica Uprising

Attica Rebellion38 years ago, a massive prison rebellion in the Attica Correctional Institution in New York reshaped national liberation movements and the growing movements against prisons in the United States.

On September 9, 1971, responding to the death of black liberation prisoner George Jackson in California’s San Quentin Prison, about 1,000 of the approximately 2,200 prisoners rebelled and seized control of the prison, taking thirty-three correction officers hostage.

During the following four days of negotiations, authorities agreed to 28 of the prisoners’ demands, but would not agree to demands for complete amnesty from criminal prosecution for the prison takeover, or for the removal of Attica’s superintendent. Under order of then Governor Nelson Rockefeller, state police took back control of the prison. When the uprising was over at least 39 people were dead, including ten correction officers and civilian employees.

On Saturday, September 12th, an event will take place in 14 various cities and prisons throughout North America – in support of political prisoners and prisoners of war. The event – known as Running Down the Walls – is a 5k run / walk / bike in support of these comrades who have been imprisoned because of their dedication to liberation and freedom.

In some locations, people will be running through parks or city streets; others will be running in prison yards and even in their cells. In all cases, they will be participating in the spirit of solidarity – the truest and purest meaning of our movements.

We will be running in solidarity for Leonard Peltier – who, on the day of the run, will be “celebrating” his 33rd birthday behind bars. We will be running in solidarity for Veronza Bowers – ordered by the courts to be released in 2005, but because of the power of the Fraternal Order of Police has been held illegally for 4 years. We will be running in solidarity for Kuwasi Balagoon, Merle Africa, Thomas Warner, Bashir Hameed, Albert ‘Nuh’ Washington, Richard Williams and all those dear and precious comrades who have died behind the prison walls. We will be running in solidarity of all those political prisoners and prisoners of war unmentioned but certainly not forgotten.

We ask that you join us on this day as an act of solidarity and Run Down the Walls!. We ask that you run for those who have fought. We ask that you sweat for those who have suffered. We ask that you care for those who have died.

Ariel Attack Update

*** LEGAL UPDATE ***

Ariel was charged with Felony 4 Criminal Mischief. What does this mean? She’s looking at 2 to 6 years in prison plus parole plus fines and restitution if convicted. That would be incredibly shitty, but Ariel has hired a lawyer and there is a good chance of staying out of prison.

Let’s not forget that while Ariel is going through some shit, this system is the reality in too many people’s lives and destroying countless families and communities. We can win some small legal battles, lose others, but the real struggle is against the courts, not in them.

Ariel has court next on Wednesday, September 9th in courtroom 12T at 9am (where the bond hearing was in the jail). This hearing will be the arraignment, where charges will be formally presented by the state and Ariel will have the chance to respond “guilty” or “not guilty”. Other things happen then too, like motions get filed and prosecutors get made fun of by the peanut gallery.

Belgrade: Anarchists face terrorism charges

Belgrade: anarchists arrested; state attorney seeks international terrorism charge Submitted by testthemalatesta on Sep 4 2009

A group of six anarchists arrested under suspicion being connected with Black Elijah (Crni Ilija), which took responsibility for the 24th August molotov attack on the Greek embassy in Belgrade.

The anarchists are members of the Sindikalna konfederacija Anarho-sindikalistička inicijativa (Union Confederation Anarcho-Syndicalist Initiative) which is affiliated to the International Workers’ Association (IWA-AIT).

The IWA-AIT Secretariat has made the following statement: We are informing you that members of the Union Confederation “Anarcho-syndicalist initiative”, Ratibor Trivunac (who is currently delegated to the duty of IWA-AIT General Secretary), Tadej Kurepa and Ivan Vulovic have been arrested today (September, 3rd) under the fabricated charges of “causing general public danger”, after they were forcefully taken in for interrogation by the police. It is yet unconfirmed if other comrades were arrested.

We are trying to get in contact with their lawyers and to establish what are the exact charges against them and their legal status. We will keep you informed of the developments.

The media later reported that the arrested are Ratibor Trivunac, Tadej Kurepa, Ivan Vulović, Sanja Đokić, Ivan Savić and Nikola Mitrović.

The judge will do hearings today and also decide about charges. State attorney has asked for them to be charged with the criminal act of international terrorism (3-15 years of prison).

Guelph, ON: Anarchists arrested amidst struggle against development

A statement from Canadian comrades:

At roughly 2:15 AM on September 1st 2009, two anarchists were arrested in Downtown Guelph for alleged anti-police graffiti. That night, three people were putting up anti-development posters downtown. The context in which this occurred is following a three week occupation of the Hanlon Creek Business Park (HCBP) development. Since the occupation, a social event was held against the HCBP where a tobacco burning ceremony took place at the site with two comrades from Tyendinaga. Dozens of signs were redecorated / defaced for all kinds of developments across the city. Development equipment was stolen from the proposed HCBP site and the trenches were re-dug across the new roads being built at the site. While taking into account the history of resistance to progress in Guelph, this occupation has created turmoil in City Hall and has also sparked a long coming social struggle against development. The occupation ended on August 14th when the courts issued an injunction against the occupiers and a work stoppage, giving the Ministry of Natural Resources (MNR) the final say as to whether the construction will continue. Last Thursday August 27th, the MNR decided that construction will continue (Duh!). These anti-development posters are a part of this diverse and ongoing struggle not only against the HCBP but all capitalist development.

When these people went out to poster, it was with a clear understanding of the possibility of surveillance and harassment. In the synopsis read in bail court on Tuesday, it was stated that the three people putting up posters were spotted multiple times over a couple hours before two of them were arrested. It was also stated in court that people who matched the same description as those putting up posters were also decorating the city with graffiti like “dead cops” and “ACAB” (which, according to the cop’s research, stands for “All Cops Are Bastards”). It was also apparent that most of the surveillance was done by taxi drivers. Those arrested were interrogated and both people remained silent and non-cooperating. The two comrades are each charged with three counts of “mischief under $5000” for the graffiti and one is also charged with obstruction.

The question of guilt or innocence about these charges only isolates the situation. There is nothing at all empowering about the language of courts. Whether these comrades indeed did graffiti is not concerning. They were expressing ideas and contributing to the struggle against development. What is guilty or innocent about that, anyway? The courts that reduce the actions of these people to a question of innocence or guilt are the same courts that approved the injunction and are handling the $150,000 lawsuit against five others. This repression began before the recent arrests and will continue after them, targeting any dissent towards the continuation of development and of business as usual.

These arrests are a clear display of the police and the city’s attempts to protect their precious development projects from the people who wish them done for. The momentum building in Guelph against all developments is a threat to the city’s economy. They’re scrambling and they’re pissed. The city is actively backing these developments, and the courts / police who protect them. It should be clear that the police and courts are responsible for the consequences of what they defend.

What are they protecting?

“Progress” is a word used by bureaucrats to create a false inevitability for the process of capitalist development. By disguising their choices and actions as something that just happens (that is simply inevitable), they can justify the consequences of their behavior. These bureaucrats enable the clearing of forests, the “revitalizing” condo redevelopment of downtown, the opening of aggregate operations and quarries, the daily pumping of 3.6 million liters of ground water, etc, without taking any responsibility for the destruction of wilderness habitats, for the rent increase and evictions, for the ruined lakes and farmland or for the damage to people’s drinking water supply. The city bureaucrats delegate private companies to do their dirty work (ie: architects, developers, private environmental assessment agencies, etc) and can avoid taking responsibility for the people and places they hurt.

Now these bureaucrats and developers, with their army of judges and cops, hope to squash out any resistance to their actions. By suing in small claims court and arresting people who act directly against development, they hope to scare others away from trying to stop the disasters. The legal system, political process, police force and economic structure will never put an end to development’s exploitation, or hold these undignified bureaucrats responsible. Who, but the rest of us, will take this struggle on and put an end to this miserable process?

We must show them that we are not afraid and that their repression only invites us to fight harder, so that they finally understand that their actions (including their repression) have consequences and it will not be tolerated.

Budget cuts force Colorado to release thousands of prisoners

From the AP:

Colorado officials plan to release roughly 15 percent of the state’s 23,000 prisoners early to help slash millions of dollars from the state budget.

Department of Corrections spokeswoman Katherine Sanguinetti says budget cuts that took effect Tuesday call for the release of 3,500 inmates in Colorado prisons during the next two years.

The move is expected to save about $45 million during the next two years.

An additional 2,600 parolees will be released early from parole.

Prisoners within six months of their mandatory release date will be eligible to get out early.

Those eligible for early release from parole have to have served at least half of their supervised term and been meeting the conditions of their release.
